By accessing and using MARAI's software platform, services, and applications (collectively, the “Service”), you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

MARAI provides software solutions including but not limited to:

  • Workflow automation and process optimization software
  • Data management and business intelligence tools
  • System integration and custom software development
  • White-label software solutions and branding
  • Technical support and maintenance services

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Payment Terms

All payments are processed securely through Paddle, our third-party payment processor. By using our Service, you agree to Paddle's terms of service and privacy policy.

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise specified
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension or termination
  • Taxes are not included and will be added where applicable

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the Service's operation or other users
  • Use the Service for illegal or fraudulent activities
  • Resell our software without proper authorization
  • Use our software for streaming services or media downloads
  • Create software that infringes on copyrights or trademarks

6. Intellectual Property

The Service and its original content, features, and functionality are owned by MARAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you create using our Service, subject to our right to use such content for service improvement and development.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Limitation of Liability

To the maximum extent permitted by law, MARAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Refunds and Cancellations

Refund policies vary by service type and are detailed in our Refund Policy. Generally:

  • Subscription cancellations take effect at the end of the current billing period
  • No refunds for partial months of service
  • Enterprise services may have custom refund terms
  • Refunds are processed within 5-10 business days

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in New York, New York and the language shall be English.
